From North Dakota's Standing Rock encampments to Arizona's San Francisco Peaks, Native Americans have repeatedly asserted legal rights to religious freedom to protect their sacred places, practices, objects, knowledge, and ancestral remains. But these claims have met with little success in court because Native American communal traditions don't fit easily into modern Western definitions of religion. This book explores how, in response to this situation, Native peoples have creatively turned to other legal means to safeguard what matters to them. To articulate their claims, Native peoples have resourcefully used the languages of cultural resources under environmental and historic preservation law; of sovereignty under treaty-based federal Indian law; and, increasingly, of Indigenous rights under international human rights law. Along the way, Native nations still draw on the rhetorical power of religious freedom to gain legislative and regulatory successes beyond the First Amendment. This book casts new light on discussions of religious freedom, cultural resource management, and the vitality of Indigenous religions today.Less

Iran's criminal courts are notorious for meting out severe sentences—according to Amnesty International, the country has the world's highest rate of capital punishment per capita. Less known to outside observers, however, is the Iranian criminal code's recognition of forgiveness, where victims of violent crimes, or the families of murder victims, can request the state to forgo punishing the criminal. This book shows that in the Iranian justice system, forbearance is as much a right of victims as retribution. Drawing on extended interviews and first-hand observations of more than eighty murder trials, the book explores why some families of victims forgive perpetrators and how a wide array of individuals contribute to the fraught business of negotiating reconciliation. Based on Qur'anic principles, Iran's criminal codes encourage mercy and compel judicial officials to help parties reach a settlement. As no formal regulations exist to guide those involved, an informal cottage industry has grown around forgiveness advocacy. Interested parties—including attorneys, judges, social workers, the families of victims and perpetrators, and even performing artists—intervene in cases, drawing from such sources as scripture, ritual, and art to stir feelings of forgiveness. These actors forge new and sometimes conflicting strategies to secure forbearance, and some aim to reform social attitudes and laws on capital punishment. Hacking, as a mode of technical and cultural production, is commonly celebrated for its extraordinary freedoms of creation and circulation. Yet surprisingly few women participate in it: rates of involvement by technologically skilled women are drastically lower in hacking communities than in industry and academia. This book investigates the activists engaged in free and open-source software to understand why, despite their efforts, they fail to achieve the diversity that their ideals support. The book shows that within this well-meaning volunteer world, beyond the sway of human resource departments and equal opportunity legislation, members of underrepresented groups face unique challenges. The book explores who participates in voluntaristic technology cultures, to what ends, and with what consequences. Digging deep into the fundamental assumptions underpinning STEM-oriented societies, the book demonstrates that while the preferred solutions of tech enthusiasts—their “hacks” of projects and cultures—can ameliorate some of the “bugs” within their own communities, these methods come up short for issues of unequal social and economic power. Distributing “diversity” in technical production is not equal to generating justice. The book reframes questions of diversity advocacy to consider what interventions might appropriately broaden inclusion and participation in the hacking world and beyond.Less

For all their unquestionable importance, the Holocaust and the founding of the State of Israel now loom so large in modern Jewish history that we have mostly lost sight of the fact that they are only part of—and indeed reactions to—the central event of that history: emancipation. This book seeks to reorient Jewish history by offering the first comprehensive account in any language of the process by which Jews became citizens with civil and political rights in the modern world. Ranging from the mid-sixteenth century to the beginning of the twenty-first, the book tells the ongoing story of how Jews have gained, kept, lost, and recovered rights in Europe, North Africa, the Middle East, the United States, and Israel. Emancipation, the book shows, was not a one-time or linear event that began with the Enlightenment or French Revolution and culminated with Jews' acquisition of rights in Central Europe in 1867–71 or Russia in 1917. Rather, emancipation was and is a complex, multidirectional, and ambiguous process characterized by deflections and reversals, defeats and successes, triumphs and tragedies. For example, American Jews mobilized twice for emancipation: in the nineteenth century for political rights, and in the twentieth for lost civil rights. Similarly, Israel itself has struggled from the start to institute equality among its heterogeneous citizens. By telling the story of this foundational but neglected event, the book reveals the lost contours of Jewish history over the past half millennium.Less

When the news moved online, journalists suddenly learned what their audiences actually liked, through algorithmic technologies that scrutinize web traffic and activity. Has this advent of audience metrics changed journalists' work practices and professional identities? This book documents the ways that journalists grapple with audience data in the form of clicks, and analyzes how new forms of clickbait journalism travel across national borders. Drawing on four years of fieldwork in web newsrooms in the United States and France, including more than one hundred interviews with journalists, the book reveals many similarities among the media groups examined—their editorial goals, technological tools, and even office furniture. Yet the book uncovers crucial and paradoxical differences in how American and French journalists understand audience analytics and how these affect the news produced in each country. American journalists routinely disregard traffic numbers and primarily rely on the opinion of their peers to define journalistic quality. Meanwhile, French journalists fixate on internet traffic and view these numbers as a sign of their resonance in the public sphere. The book offers cultural and historical explanations for these disparities, arguing that distinct journalistic traditions structure how journalists make sense of digital measurements in the two countries. Islamic book culture dates back to late antiquity, when Muslim scholars began to write down their doctrines on parchment, papyrus, and paper and then to compose increasingly elaborate analyses of, and commentaries on, these ideas. Movable type was adopted in the Middle East only in the early nineteenth century, and it wasn't until the second half of the century that the first works of classical Islamic religious scholarship were printed there. But from that moment on, as this book reveals, the technology of print transformed Islamic scholarship and Arabic literature. The book tells the story of how a small group of editors and intellectuals brought forgotten works of Islamic literature into print and defined what became the classical canon of Islamic thought. Through the lens of the literary culture of nineteenth- and twentieth-century Arab cities—especially Cairo, a hot spot of the nascent publishing business—the book explores the contributions of these individuals, who included some of the most important thinkers of the time. Through their efforts to find and publish classical literature, the book shows, many nearly lost works were recovered, disseminated, and harnessed for agendas of linguistic, ethical, and religious reform. In July 2010, Terry Jones, the pastor of a small fundamentalist church in Florida, announced plans to burn two hundred Qur'ans on the anniversary of the September 11 attacks. Though he ended up canceling the stunt in the face of widespread public backlash, his threat sparked violent protests across the Muslim world that left at least twenty people dead. This book demonstrates how the beliefs of fanatics like Jones are inspired by a rapidly expanding network of anti-Muslim organizations that exert profound influence on American understanding of Islam. The book traces how the anti-Muslim narrative of the political fringe has captivated large segments of the American media, government, and general public, validating the views of extremists who argue that the United States is at war with Islam and marginalizing mainstream Muslim-Americans who are uniquely positioned to discredit such claims. Drawing on cultural sociology, social network theory, and social psychology, the book shows how anti-Muslim organizations gained visibility in the public sphere, commandeered a sense of legitimacy, and redefined the contours of contemporary debate, shifting it ever outward toward the fringe. Drawing on extensive ethnographic research among rank-and-file activists in Morocco, the book shows how Islamist movements are encountering opposition from an unexpected source—each other. In vivid detail, the book describes the conflicts that arise as Islamist groups vie with one another for new recruits, and the unprecedented fragmentation that occurs as members wrangle over a shared urbanized base. Looking carefully at how political Islam is lived, expressed, and understood by young people, the book moves beyond the top-down focus of current research.
